Terms of Service

What you can expect from us when you order, what we expect back, and where the limits of both sit. Written to be read rather than skipped.

1. Who these terms are with

These terms govern your use of ultimocall.com and any order you place with ULTIMOCALL Audio (“ULTIMOCALL”, “we”, “us”). Using the site means you accept them. If you do not, please do not use the site.

Nothing here is intended to take away rights that consumer law in your own country gives you and cannot be waived by agreement. Where a clause below conflicts with such a right, that right wins and the rest of these terms still stand.

2. Using this website

The site is provided for information and for contacting us. You may read it, print it and link to it. You may not scrape it at a rate that degrades it for other people, attempt to interfere with it, or present it as anyone else's.

3. Product information

We take care to describe our products accurately, and the figures on this site are the ones we measured, under the conditions stated beside them. Two things follow from that:

  • Battery figures are conditional. On earbuds, “40 hours” means eight hours in the buds and thirty-two in the case, at 50 % volume on AAC with noise cancelling off; the ANC-on figure is published beside it for that reason. On the speakers it means forty hours on one charge, also at 50 % volume. Volume, codec and temperature all change both.
  • Noise-cancelling figures are a curve, not a promise. Attenuation depends on the seal you personally get, and no earbud meaningfully cancels speech. The per-band figures on the homepage were measured on a head simulator with the medium tip.

Product photographs show the item you receive. The speaker illustrations are drawings rather than photographs and are not to scale, and the campaign posters are artwork — where a poster and a product page disagree, the product page governs. Colours vary between screens. Specifications may change as models are revised; the page describes the version currently shipping.

4. Orders

Orders are placed by email. Nothing on this site is a binding offer: our reply confirming stock and a total is an invitation for you to pay, and a contract is formed when we accept your payment and dispatch the goods. Until then either of us can walk away.

We may decline or limit an order — for example where a price or specification was obviously wrong, where stock has gone, where we cannot lawfully ship to your destination, or where an order looks fraudulent. If we decline after you have paid, we refund in full.

5. Prices, payment and taxes

Prices on this site are in US dollars and include worldwide shipping. Payment is taken through a payment provider using a link we send you; we do not process or store card details.

Import duty and local sales tax are not included. They are levied by the country the parcel arrives in, are payable by you to the carrier or the customs authority, and we cannot tell you in advance what they will be. Refusing a parcel because of a duty charge is treated as a return under §7, less any carrier costs we cannot recover.

6. Shipping and delivery

Shipping is free and tracked to every country we can lawfully ship to, with no minimum order. We dispatch within one to two working days and email you a tracking number. Typical transit is three to eight working days once the parcel is moving.

Delivery estimates are estimates. Customs inspections, carrier delays and weather are not within our control and are not grounds for a claim beyond the remedies in §7 and §8. Risk in the goods passes to you on delivery.

7. Returns and cancellation

You have thirty days from delivery to return anything for any reason. Tell us by email first; we send a prepaid label and cover the return shipping. Refunds are issued to the original payment method once the parcel reaches us, normally within five working days.

Goods should come back complete — buds, case, cable and all four tip sizes. For hygiene reasons we cannot resell used silicone or foam tips, so opened tips are not deducted from your refund and do not need to be returned unused; everything else should be in a condition that lets us resell it. We may reduce a refund to reflect handling beyond what is needed to try the product.

8. Warranty

Every product carries a twenty-four month warranty from delivery, batteries included. Within that period we repair or replace anything that fails in normal use, at our option, and we cover the shipping both ways. Single buds and cases are replaced individually — a fault in one bud is not a claim against the pair.

The warranty covers manufacturing and material defects, and battery capacity falling below 80 % of the rated figure inside 500 full charge cycles. It does not cover:

  • immersion damage on models rated IPX5, which is a jet rating and not an immersion rating, and immersion beyond 1 m for 30 minutes on the IP67-rated speakers;
  • physical damage from crushing, drops beyond the tested 1.2 m, or being sat on;
  • wear items — silicone and foam tips, and the finish;
  • units opened, modified or repaired by anyone other than us.

9. Safe listening

Sustained high volume damages hearing permanently. Our products implement the EN 50332-2 volume limit and warn you when you override it; please do not ignore that. Do not use noise cancelling or any wearable audio where you need to hear your surroundings to be safe — including while driving, cycling or operating machinery — and check your local rules, which in some places prohibit it outright.

10. Radio equipment

These are radio products, approved for the markets listed on the homepage. You are responsible for using them in line with the rules of the country you are in, including on aircraft and in any facility that restricts radio transmitters.

11. Intellectual property

The ULTIMOCALL name, logo, product names, site copy, illustrations and firmware are ours or licensed to us. You may not copy or reuse them commercially without written permission. You may not reverse-engineer, decompile or redistribute the firmware except where local law expressly allows it despite an agreement to the contrary.

12. Liability

We are liable for foreseeable loss caused by our breaking these terms or by our negligence. We are not liable for indirect or consequential loss, loss of profit, loss of data, or loss arising from use of the products in a way we have advised against. Where our liability can be limited by law, it is limited to the amount you paid for the goods concerned.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

13. Governing law

These terms are governed by the law of the place where ULTIMOCALL is established, and the courts there have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of your own country of residence, and you may bring proceedings there.

14. Changes

We may update these terms. The version that applies to your order is the version published when you placed it, and the date at the top of this page tells you which that was.
